Terms of Service

Summary: By booking AerialCraft's services, you agree to these terms. We'll show up, fly safely, and deliver great footage. You pay on time and use the footage as agreed. Simple.

1. Agreement to Terms

By accessing our website at aerialcraft.ca or booking any service from AerialCraft Drone Studio ("AerialCraft," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

AerialCraft provides professional drone photography, videography, and related aerial media services including but not limited to:

  • Real estate aerial photography and video
  • Construction progress documentation
  • Event coverage (weddings and corporate)
  • Promotional business videos
  • Orthomosaic mapping and site inspection

All services are subject to availability, weather conditions, and regulatory compliance.

3. Booking & Payment

Booking confirmation: A booking is confirmed upon receipt of a signed quote or written confirmation (email is acceptable) and any required deposit.

Deposit: A 50% deposit is required to secure your booking date. The remaining balance is due upon delivery of final edited footage.

Payment methods: We accept e-Transfer, credit card, and other methods as agreed in writing.

Late payment: Invoices unpaid after 14 days may incur a 2% monthly interest charge. We reserve the right to withhold deliverables until payment is received in full.

Taxes: All prices are in Canadian dollars (CAD) and exclude HST, which will be added where applicable.

4. Cancellation & Rescheduling

  • Cancellation 7+ days before shoot: Full deposit refund
  • Cancellation 3–6 days before shoot: 50% of deposit retained
  • Cancellation less than 48 hours before shoot: Full deposit is non-refundable
  • Rescheduling: One rescheduling is permitted at no charge with 48+ hours notice, subject to availability

Weather cancellations: If unsafe weather prevents the shoot (as determined solely by AerialCraft), we will reschedule at no charge. This does not entitle the client to a refund if the shoot is rescheduled rather than cancelled.

5. Regulatory Compliance

AerialCraft operates under a Transport Canada Advanced Operations certificate and complies with all applicable Canadian Aviation Regulations (CARs). We will obtain all necessary airspace authorizations (RPAS flight plans, NAV CANADA NOTAMs, etc.) required for each shoot.

The client is responsible for obtaining any necessary permissions from private property owners and for informing us of any known site restrictions, security requirements, or hazards. AerialCraft reserves the right to cancel or modify a shoot if conditions are deemed unsafe or non-compliant with regulations.

6. Client Responsibilities

The client agrees to:

  • Provide accurate project information including location, access requirements, and relevant contacts
  • Ensure AerialCraft personnel have safe and legal access to the shoot location
  • Notify AerialCraft of any hazards, restricted areas, or special considerations
  • Obtain any required permits from property owners or local authorities
  • Not request AerialCraft to fly in violation of any law or regulation

7. Deliverables & Revisions

Delivery timeline: Edited footage is delivered within 48 hours of the shoot unless otherwise agreed in writing.

Delivery method: Files are delivered via a secure shared link (Google Drive, WeTransfer, or similar). Links are active for 30 days; clients are responsible for downloading and storing their files.

Revisions: Our Professional and Enterprise packages include unlimited revisions. Essential package includes one revision round. Additional revision rounds may be billed at $75/hour.

Raw footage: Raw, unedited footage is not included in standard packages and may be provided for an additional fee upon request.

8. Intellectual Property & Usage Rights

Client licence: Upon receipt of full payment, AerialCraft grants the client a non-exclusive, perpetual, worldwide licence to use the delivered footage for the purposes agreed upon (commercial or personal use as specified in the package).

AerialCraft portfolio rights: AerialCraft retains the right to use delivered footage in our portfolio, website, and marketing materials unless the client requests confidentiality in writing prior to the shoot. We will never disclose client-sensitive information alongside portfolio footage.

Ownership: AerialCraft retains copyright ownership of all footage. The client receives a licence, not ownership of the copyright.

Third-party use: The client may not resell, sublicence, or transfer footage to third parties without prior written consent from AerialCraft.

9. Satisfaction Guarantee

If you are not satisfied with the delivered footage, please notify us within 7 days of delivery. We will make reasonable efforts to reshoot or re-edit at no additional charge. If we are unable to resolve the issue to a reasonable standard, we will offer a partial or full refund at our discretion. This guarantee does not apply where dissatisfaction results from factors outside our control (weather, client-provided instructions, access restrictions, etc.).

10. Limitation of Liability

AerialCraft carries $5M commercial liability insurance. To the maximum extent permitted by law:

  • Our total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific project in question
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not responsible for losses due to weather-related cancellations, equipment failure beyond our control, or access restrictions caused by third parties

11. Indemnification

The client agrees to indemnify and hold AerialCraft harmless from any claims, damages, or expenses arising from: (a) the client's misuse of delivered footage; (b) the client's failure to obtain required permissions; or (c) inaccurate information provided by the client.

12. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to Terms

We reserve the right to update these Terms at any time. Changes take effect upon posting to our website. Continued use of our services after changes constitutes acceptance. We will notify existing clients of material changes via email.
